We earlier wrote about drunk driving defenses in Pennsylvania. Now reading about the Cherelle Parker DUI, one would guess that the state representative also saw the post as she is currently offering just about every DUI defense available to rebut her charge.
In April, Parker was pulled over for allegedly driving the wrong way down a one-way street, reports the Philadelphia Daily News. Police say they stopped the representative and noticed signs of alcohol use such as glassy eyes, slurred speech, and the smell of alcohol. They say Parker was unsteady on her feet and failed a Breathalyzer test. The officers testified that Parker admitted to drinking two beers and two martinis.
Parker denies all of this. First, Parker says that she was not driving the wrong way down Haines Street in Germantown and so police did not have probable cause to make the stop. Generally, police need a reasonable belief that someone is driving drunk to make a stop. This can include erratic driving or driving the wrong way down the road.
Next, Parker denies that she told police she had consumed four drinks, reports the Daily News. Parker says that she told police that she had a single chocolate martini, and that was it. In addition, Parker says that police have no way of proving that she was drunk as she claims that the Breathalyzer device was not calibrated properly, and so could not be relied upon.
The Cherelle Parker DUI is offering a nice lesson on the defenses to drunk driving. It will be interesting to see if any of her defenses stick.
